Cheque Bounce ; Mohali

I have given 30,000 friendly loan to one Government servant. he gave me half amount in equal instalments. but from last 6 months he is not paying my money. today I deposited 20000 cheque from his cheque. bank has refused by saying Insufficient funds. please take your cheque back. Please suggest what i can do here , if i opt for Cheque bounce. he is serving in Police department. i want my money back and want to teach him lesson as well.

Firmly give him notice for full and final payment of principal amount. If he is not willing to give you the money you should file a complaint. It doesnot matter if he is police official. If your contract is breached you should have knock for remedy.

In response to ur query , I advice you to first send a legal notice within thirty days from the date of knowledge of the bank memo , if the amount is not paid within fifteen days than u have a right to file the complaint within thirty days after the expiry of the given time

Under Negotiable Instruments Act, 1881, your rights are safeguarded. On an event of cheque bounce, you can file the complaint in court of specific jurisdiction. Please keep proof of how you disbursed Rs 30,000 to the person, this will help court to determine the liability against which the cheques were issued.

Please hire a lawyer to file your complaint and claim your money back. Rest, law teaches lesson to everyone, somewhere not exactly sure when.

Dear client, you have very good remeady under negotiable i strument act .By filing complaint under this act , you can recover your money as well as teach your friend a lesson by getting him punished through court of law. but is a time bond process. u will have to take advise of an advocate. for more query meet me personally.

According to Negotiable instrument Act section 138 , you should send him legal notice within 30 days from bounce. If he did not pay, you may file a complaint in court. Court will summon him as a accused. if court will be satisfied, That person will be ready to pay your amount. Police cannot do anything in this matter, because matter will be pending in the court.

He himself gave you the cheque or given as security cheque?
Do Complaint under Section 138 of the Negotiable Instruments Act, 1881.
It's easy to recover from gov employer
If he fail,give his salary account to court to recover your amount

Heloo.....sir k ek sufficient hall n.i.act ma diya huva ha..App sub say phala kesi advocate ka pass ja k os person ko notice do...vo notice immediately do jis ma fiftenn days k time diya jata ha agar vo mony vapis Na kra to fir one month k beach os k against complaint file kr do..jis ma punishment ki provision ha..govemnt servant hona krk sure ha k vo apki money return kraga he ap k sath compromise krk..ja nhi krta to punishment ki provision to ha e ha...s ka dusra was recovery civil suit b ha jis ma only mony return hoti ha s ma punishment ki provision nhi ha....s k liya better way to punishment means criminal complaint e batter ha jis k way say apka passa vapis a sakta ha agar nhi atta to punishment to sure ha...but dely Na kro immediately notice do or complaint file kro..
