Q: Court granted stay on property, How can i sell the property?

I bought a flat 4 years back in resale. Registry done, later on realized that seller already sold to someone. Now the case is in court and court has granted stay on the property. What can i do if i want to sell the property, whether land can be sold during pendency case in court ?

you should go in the court with counsel and file a application for early hearings. Because, there is a law under section 52 T.P. Act, when a case is running against a property in the court, Owner cannot sale the property. If you will do it, it will become null and void. So, you can make a request to the court for early hearing. you should wait for the final decision of the court. because, at this time, nobody will ready to purchase your house.

Q: Can I get a government job again after serving 4 years of imprisonment in India?

I was charged under Section 307 IPC and served 4 years in prison. While working with Punjab Police, I was dismissed from service. Can I file a writ petition to regain my job since I have completed my sentence?

No, dear you cannot get your job again. Because according to service act, If a person did a crime under Indian Penal code, before the joining , he will not eligible to get job. If a person did a crime under IPC during the Job, he will be suspended immediately and after conviction he will be dismissed. If a person acquitted in the court, he can join his job again. You should go for appeal, if you will be acquitted in appeal, you get back your job without any writ.

Q: Small token money agreement not making payment

I make a agreement one year back with person he paid us token money 50000 only against total sale amount 93.6 lac but he has not mentioned any end date of agreement and no terms mentioned to complete the payments. I am requesting him to make payment but he ignored. He also said I cannot sell my property to any other. Where end date is not mentioned and buyer is not paying balance payments then how it cancell

send him a legal notice in which you have to demand balance share price and ask him to register a regular sale deed on a specific date. Failing which said agreement to sell would be cancelled automatically is also written in said notice

Q: Not happy to live with my wife , thought conflicts , incentives

Plz help me to get seperated from my wife and get custody of my children ,she is adamant and inclined towards her parents rather taking care of my family in which only me and my mother is there , not understands the situation, always take up only what's in her mind , 10 years now , threatening of false implications in cases , I fear for that
