What are boundary wall rules in west bengal panchayat? Is it mandatory to leave 3 feet space and then construct a boundary in own land? We have a vacant land under Gram Panchayat. The land (0.07 acre) has Daag No- 2705 (rectangular shaped land) with two people equal share i.e we have 50% share. The other people has already constructed their house (Indira Awas Yojona by Govt) and have not left any space. Now Panchayat is backing one particular person and obstructing us to construct boundary and gate in our vacant land. We had filed for injunction and temporary injunction have been granted for 1 month. But Gram Panchayat Pradhan is forcing us to leave a 3 feet space (to make a road along our land) and then construct the boundary wall else not. The other person who has 50% share in the daag number had not left any space. Kindly help what to be done in this regard.

Though it is necessary to leave some space for the Government, despite you file a RTI before your gram panchayat.
Thereafter you may take the panchayat and the other party before the High Court for equal before the law. Till the pendency of this writ you may go for extending the injunction before the lower Court.

You have already approached and the Court. The Court can allow to construct. Gram Panchayat Pradhan cannot do anything. And since the other owner has already constructed under government project, I think the Court will allow you too. Take a local Advocate to plead your case in a better way. The permission of the Gram Panchayat is not required for the construction of a wall, unless it's made of bricks or cement. Also, if it's not a vacant area but is being used for commercial or institutional purposes or is likely to be for stack yards or other open spaces or temporary structures.
