There are procedure which requires to be followed. You need an advocate for this work. To assist further, I need to know your municipality name. Or better call us sometime so that I can make you understand in a better way.

Q: Delaying in registration by builder

Possession given in Nov 2018 and all documentation and payment done but not being fulfilled the registration formalities..

Advocate Raja Satyajit Banerjee answered
All you need to do is immediately send a legal notice for registration and provide a time and if not complied then you have to approach the consumer court. If the project is registered under the West Bengal Housing and Industrial Regulation Act then you can approach the concerned authority otherwise you have to approach the consumer court. If you want any further legal opinion or want to initiate any case as i said above, in that case please contact us.

Q: Exchange Deed and exchange of Structure with land

Sir,I am trying to explain in simple language. There are two parties in an EXCHANGE DEED. Party1 gives Party2 0.63 decimal of land (Market value 1.2 lacs). Party2 gives Party1 a structure (house/room) of 120 sq.ft. (Market Value 90 thousand). Now there are two queries.1. Do we need to equalise the market values of both properties (with cash or by other means) ? ORunequal (in terms of market value of both properties) EXCHANGE is allowed? (I means whether party 2 also have to pay 30000 in cash to Party 1).2. Only transfer of structure (only structure and not the land on which the structure is constructed) is allowed or not ? I mean whether party2 can transfer 120sq.ft structure ALONEORdo party2 need to give 120sq.ft of LAND ALSO with 120 sq ft structure?THANK YOU.

Advocate Raja Satyajit Banerjee answered
(1) Exchange is allowed. It is called Family Settlement. Make a deed and get it registered.(2) Normally in exchange, when any property is transferred, it comes with the land. To give the structure only, one has to make Special Deed recording various facts in accordance with the law and get it registered. For any further questions, please call

Q: Panchayat rule For Construction Of Boundary Gate

What are boundary wall rules in west bengal panchayat? Is it mandatory to leave 3 feet space and then construct a boundary in own land? We have a vacant land under Gram Panchayat. The land (0.07 acre) has Daag No- 2705 (rectangular shaped land) with two people equal share i.e we have 50% share. The other people has already constructed their house (Indira Awas Yojona by Govt) and have not left any space. Now Panchayat is backing one particular person and obstructing us to construct boundary and gate in our vacant land. We had filed for injunction and temporary injunction have been granted for 1 month. But Gram Panchayat Pradhan is forcing us to leave a 3 feet space (to make a road along our land) and then construct the boundary wall else not. The other person who has 50% share in the daag number had not left any space. Kindly help what to be done in this regard.

Advocate Raja Satyajit Banerjee answered
You have already approached and the Court. The Court can allow to construct. Gram Panchayat Pradhan cannot do anything. And since the other owner has already constructed under government project, I think the Court will allow you too. Take a local Advocate to plead your case in a better way. If you need any more assistance, please call me. Thanks
