Other residents of my building pressurising me to cover the main shaft of building with fiber sheet

06-Jul-2023 (In Civil Law)
I live in a flat situated in a builder floor and some residents have extended their flats in the shaft area as well. Now, all the other residents have formed a gang and are demanding that the main shaft be covered because their extended room get seepage in rainy season. I do not want the shaft covered as it will restrict the movement of air and sunlight in my house, but everyone is pressurising me to get it done. Is it legal to cover the main shaft of building? Can I refuse it or will I have to eventually agree to it? Please help.

As per sanction plan, shaft is shown as open area.
open area is not included when calculating amount of house tax.
incase open area is covered in practice but shown as open area in sanction map, it will cause problems with Municipal Authorities.
Therefore, you must not allow open area to be covered.

First of all send them a legal notice regarding your grievances. But if the behaviour of your neighbours are intolerable towards you and you want to go legal then you can always file a written complaint with the police station of your area. For more legal assistance I am just a call away.

Certainly not, it’s not compulsory rather if it is against the building plan sanctioned you should not be ready for it. Let them pressurise if they do so make a complaint to police and if they don’t stop even then, make a complaint to concerned department. If nothing works out the court is the final option where we can go for restraining them to do so

You see shaft is designed as per architectural approach as and when authorities instruct to develop a house or any structure it require the developer to follow the rules and guidelines. Unless they follow said norms they will be penalised or prosecuted by the concerned authorities. It is your prerogative to close the shaft or not to close it, but as you said your building neighbors are forcing you to do it you can decide it whether it restricts your clear air and ample sunlight
