Gave money to a friend but now he is not returning the amount

I gave some amount to my ex colleague in last company 2 years ago He promised to return it back but now he just escaped and not in touch. how can I take action against him.

If you have given money to your friend have you sign any deed or agreement stating the amount given and the return date with interest if any. If there is any such agreement or deed then you can go to the local police station get a fir registered claiming cheating. If there is no such agreement then it will be very difficult to prove that you had given any loan. If you have any bank transacting showing transfer of fund from your account to his then this is also good enough to satisfy your claim . Hope you have some kind of evidence to claim your statement.

The first and foremost step that you can take its threaten your ex colleague by sending a strong legal notice stating that if he doesnt repay then you will proceed to court. if he fails to return the money then you can proceed with filing a case in the courts seeking repayment of money and also interest on the same. Do you have any written agreement with him? Also, have you written any letters/emails to him earlier? Has he ever by way of sms or email or letter acknowledged that he has to repay you this amount? If yes, then you can file a summary suit where the burden will always be on your ex colleague. Summary suits are faster remedy as well. Please answer my above questions, so that I can advise you better.

First all you need to have proper documents explaining the transaction between you and your friend. If any such documents exists then file a suit for recovery against him. If such document is not their, ask any lawyer to simply send a legal notice to your friend asking to refund the money, if he replies to such notice and still does not return the money, then, based on his reply to your legal notice you can file the suit.
