I live in Delhi and I lent Rs.1lakh to someone in Punjab through money transfer (Bank to Bank) to a 3rd person and the 3rd person gave money to him. Now he is refusing to give money back. His father is agree to give me in written on stamp paper against him. But the son is refusing to pay money. what to do if someone is not returning your money in india?

you should immediately send a legal demand notice also need a proof of the payment to the person and his details. incase he fails to reply you can innitiate proceedings against him in the court of law

You can send him a legal notice and you will get your amount within 15 days. Dont delay to send the legal notice as you wont get it if delayed. Send the notice under section 138 of negotiable instruments act.

Firstly you will send a leagl notice to raise your demand and gave him 15 days time then you will file a civil recovery suit against them before court and after filing the case the court issue notice to them

A criminal lawsuit can be filed by the borrower if they prove that the person who borrowed the money committed a criminal breach of trust. He can file a suit under Section 420 IPC, because the person he lent money to defrauded them. Also under Section 406 IPC, for Criminal Breach.
