Creating legal will for multiple state property

Hi, nMy mother has 3 property in Delhi, UP and Karnataka. She want to create a will but would like to know the correct procedure. n1. Is registration preferred for will, or can unregistered will signed by 2 witnesses hold its ground. n2. Can we get the will made in any state or we need to make the will made in all three state for the respective property in that state. n3. Can a video recording of her wishes be sufficient and considered as a will?

A Will can be made and executed at your mother’s place of residence. In case of anticipated disputes between the legal heirs, it is advised that the will be registered.

Will has to be as per law of Indian Succession Act. It has to be written on a piece of paper by the propounded with her free will and has to be signed by two witnesses. Registration of Will in Delhi is not mandatory as per law. Also one Will can include all the assets of the testator. For any further clarification feel free to contact

Will is a document showing the wish of the testator, however effective after the death of the testator. As such, until and unless there is consensus among all the legal heirs, the Will remains challengable. So it is advisable to get it registered to form a part of government record and use it anytime as a proof of execution. Secondly, one will can be executed incorporating any number or properties and the same can be regsitered at any single place irrespective of where any property situate. However, in some states probate (order from court) is compulsory and in some it is discretion. I will suggest getting it registered where the testator lives. Only recording cannot be taken as WILL but can be used to show the execution.
