Questions Answered by Advocate Abhinav Sharma

Q: I would like to inquire about the fees for FIR quashing, including the court fees for the quashing o

I'm looking to find out the fees for FIR quashing. The case was settled in Patiala House Court and disposed of in Lok Adalat under sections 420, 419, and 120B. I've heard that quashing is possible for under 25,000/-. What are the court fees for the quashing of FIR?

Advocate Abhinav Sharma answered
Hi In case your case has already been disposed. There is no need to get the FIR quashed. In case it is settled / compounded then you don’t need to get the FIR quashed. Feel free to get in touch to discuss further.

Q: Change of Name in Property Registry.

My house property is in name of my grand mother in law, we want to change name in property registry, my husband is also no more, I have Death Certificate of my Mother in law and Husband. We have Property Tax Receipt of more than 10 years, that we are paying to municipal council. Please tell it is possible to change name in Property Registry on the basis of Death Certificate and Property Tax Receipt. Please note that we don't have will, so please tell what will be the formalities for name change in property registry. If not possible, how to get succession from court, if we file the case. Thanks.

Advocate Abhinav Sharma answered
Dear Client The name in the registry will not be updated basis the death certificate. The rule of succession will have to be followed. In case all the legal heirs (remaining) are willing, in that case, the property will be mutated in their names equally. If there is a dispute, the you will have to approach the court for appropriate orders. Feel free to get in touch to discuss further.

Dear Client In case the notices were dropped on your address in Delhi. The court can assume that your wife has sufficiently served you and then proceed with the matter. Q: Sub sub license agreement validity when it is only executed on a stamp

If the Sub sub-license agreement is executed on a stamp paper worth Rs. 100 and has not been registered, can the lessor issue an eviction notice under Section 106 of the Transfer of Property Act?
