Procedure to give notice of khula to my husband

01-Jul-2023 (In Muslim Law Law)
I have been married for more than 11 years. I am a conservative Muslim but my husband's family is not. Knowing all about me, my husband will fully mislead me into the marriage. He used to drink and had female friends before marriage. I don't know what was the extent of these relationships he had. He isolated me from ALL my and his friends and family right from our marriage. 3 years back he had an affair with a colleague which he denies. Lately he has been having another affair with another colleague. I am sick of this and want khula. What is your advice and guidance please. I have no proof of his wrongs except circumstantial ones. He is not ready to leave me. I want to at least give him a notice of khula.

Khala can be issued in two ways. The first is consensual whereby the husband agrees to divorce you but with certain conditions and those conditions are at his will;
While under 2nd circumstances, Khula can be obtained from Qazi if the lifestyle of the husband doesn’t resembles as prescribed by Islam. The degrees may vary.

As you stated that your husband drinks and he has been having extramarital affairs and other misdemeanours, accordingly you shall obtain Khula but the process might be a little tougher.

But in my opinion try meeting a lawyer and understand and plan your every move before initiating anything.

Regards.
