Landlord not giving back Half Month Rent of £290+Deposit of £100

18-Nov-2023 (In Landlord/Tenant Law)
This thing happened with me in Nov 2016, in UK. I paid my monthly rent of £ 580 for period from 28th Oct till 28th Nov, on 31st Oct. My landlord gave me a notice by sending WhatsApp Message & via Email on 3rd Nov to vacate the room occupied by me & my family, in their house on 13th Nov, for doing pest control in our room. I replied to them on same day/ 3rd Nov -- thru WhatsApp Message and Email stating - "I'm ready to vacate on 13th Nov as per notice/ requested. But before vacating, I need my Nov 2016’s already paid Half Month Rent of £290+Deposit of £100, back." I followed up for same till 13th Nov with Landlord. But I was getting no response. On 13th Nov, Landlord came late in evening & asked to vacate the room & said, they will not give my money back. With no other “fair option” given to us by our Landlord; we “unwillingly” said ok & vacated the room/ house on requested date 13th Nov. I'm coming to India, Pune on 4th Dec. So how I can file case against him from India, Pune?

If the lease deed is silent on the manner of hand over of the possession and refund of the security deposit then both the phenomenons shall take place simultaneously. The clause in sale deed, if any, with respect to the return of deposit and hand over of possession will take effect. Lessor has the right to carry out, prior to refunding the security deposit, an inspection of the premises to ensure that no damage has been caused to the premises due to an act of the lessee. A lessee is liable to compensate the lessor for any damage caused to the premises due to his act. This is a right which cannot be denied to the lessor. If security deposit is not returned by the lessor even after possession being returned in accordance with the mode enshrined in the lease deed then you may file a lawsuit for recovery of mone
