Remedy in case Tenant is Not Paying Any Rent since past 10 years

A tenant is residing in a room in a chawl system owned by me since 40 years. I am paying the property tax for the said room. He is not paying me the rent for last 10 years, also not ready to vacate the property. He has renowned the ro recently. And now he is preparing to give the room to some other person on rent. What can be done? Please guide.

As per the limitation act, you can recover the arrears of rent only for upto 3 years. You have to first serve a demand notice of rent. And if he doesn't comply with the same u can file a eviction suit for non-payment of arrears of rent. You can also in that suit file an interim application of temporary injunction for not to create third party rights and interests i.e not to sell the suit premises till final decision of the suit.

Firstly a legal notice needs to be issued to the tenant thereby terminating the tenancy on the ground that he is not using the room anymore and that he is trying to induce third party in the room (sub-letting) Once notice is issued, suit can be filed against tenant.
