Applying for a Canada visa? Here is what you should know
August 15, 2022 हिंदी में पढ़ेंTable of Contents
When you decide to visit Canada, you will need a visa. A visa is a permit that allows you to travel to and remain in Canada. Canada Border Services issues visas to visitors.
Migrating to Canada is a different experience as compared to other countries, it is one of the most popular destinations for travelers who wish to visit for tourism or to settle there permanently.
You can apply for a permanent resident category even before visiting Canada as long as you fulfill the requirements.
There are two categories under which one can apply to visit Canada.
1. Temporary residence - which is a visitor's visa. This is for people who wish to visit Canada for business, pleasure, work, or study on a temporary basis.
2. Permanent residence - for people who wish to move to Canada and reside there permanently.
This article will walk you through why your visitor's visa has been or can be rejected and the steps you can take to avoid refusals.
The three main categories of temporary residence visas are
1. Tourist visa
2. Study visa
3. Temporary work visa
In order to apply for a visitors visa or a temporary resident visa, you must submit an application with the Immigration, Refugees and Citizenship Canada (IRCC).
The main documents you require for this are:-
& ndash Forms
& ndash Fees
& ndash Photos
& ndash Passport
& ndash Proof of financial support
& ndash Photocopy of your return ticket and/or travel itinerary
& ndash Any additional documents required by the local visa office
Getting a visa is a journey and sometimes, despite feeling like you have met all the requirements, your application may be denied. This can be for a variety of reasons. Contrary to popular belief though, you can sometimes appeal the decision. Reapplication is also a possibility in some cases.
However, it is important to note that you may not be able to reapply for six months if you have received a refusal under any category.
If you have any queries regarding this you may contact Advocate Farhat Warsi Singh for clarification of the same.
Why your visa was rejected and how you can prevent a refusal
1. Incomplete or inaccurate supporting documents
Making sure that your information is complete and its correctness is of paramount importance. You must make sure that you review all the documents very carefully. Minor mistakes would lead to refusal.
Make sure that you prepare a checklist of all the documents required so they are complete. Check every document thoroughly before submitting it.
2. The visa officer has reservations regarding your intention in applying for the visa
When applying for a visitor's visa to Canada, you must prove your intent “ not to immigrate” . You must prove that you have strong ties to your home country, such as family, property, and employment.
If you are unable to prove that you have strong ties to return to your home country, it might make the visa officer suspicious of your intent and your visa might get refused.
3. Failure to show adequate financial resources to finance your travel to and stay in Canada
If you are unable to prove that you have sufficient funds for your trip including costs of accommodation during your stay in Canada, your visa request will be refused. Make sure that you attach the appropriate bank statements to demonstrate your source of funds.
4. You do not meet international security standards
Your visa application may be denied because you fail to meet international security standards. For example, if you have been found guilty of any crimes.
5. You do not meet health standards
Every person that applies for a visa to Canada must undergo a medical examination beforehand. Your visa may be denied if you fail to meet health standards.
Ensure that your medical report is completed in the time required.
6. Your travel history has discrepancies
If you have overstayed the term of your visa in Canada or any other country, it may lead to a refusal of your application.
7. Your Travelling History
If you have not previously travelled to any other country before applying to Canada your visa may be refused. Note this excludes travel to Thailand, Hong Kong, China, and other Third World Countries.
Keep in mind the following things, if you are reapplying for a visa after it was refused-
1. Consider reapplying
Depending on the case, you may be eligible to reapply. This can be done either with the IAD (Immigration Adjudication Division) or the Federal Court of Canada. This appeal is only valid for a certain time and should be acted upon immediately within the stipulated deadlines.
It would be a good idea to enlist the help of a professional to ensure that your application does not get refused again.
2. Correct the initial mistakes
Make sure the initial mistakes that you made are now corrected. Ensure that you furnish a reason to the authorities for not submitting this information before. This new information should have fresh evidence in your favor, eg.- an updated bank statement showing that you have sufficient funds to support your stay in Canada. Where you did not before. Explain well why you did not provide this information before and why it is relevant.
