Q: How to fast track divorce by mutual consent ?
sister was forced to marriage a guy she loved 2 years ago and they registerd their marriage in panchayat without permission from us. but she never leaved with him and now both are ready to mutually divorce their relation so please tell me what is the mutual divorce procedure ?,how long will it take? are their any easy ways? There is no easy way out for you other than to get a decree of divorce from a family court of competent jurisdiction. It can take for a period of 6-8 months after filing of the petition for divorce. Q: Can rape case be filed after many years had passed in India?
Could a woman be able to file a rape case in India even after so many years of the incident in India?

The recent incidents makes police to have a rethought and insists on a preliminary investigation into the merits of the case in such matters where there is delay. Theoretically issue of delay is not applicable to file a cognizable offence like rape, though delay in lodging FIR is a ground of defence for the accused..
Q: Can impotentcy can be ground for divorce in India?
My wife and her parents are trying to sue me, claiming I am impotent. I personally do not have any health issues, but I didn't undergo any medical check-up prior to marriage. We have not had sexual intercourse in the last four months. After our engagement, we faced several issues with them and tried to cancel the marriage, but they didn't allow it. Now, if I am tested positive for impotency, what will be my fate? My parents insisted on the marriage, and that's all I have done. I come from a poor family but have a good job, while my wife is from an upper-middle-class background. She is asking for a divorce. Our marriage is now four months old. Please give me suggestions. Both of us are Hindus, and the claim of impotency is being used as a ground for divorce.

Your wife can sue for divorce on the basis of impotency. But if you object to it in the court of law, they have to prove it by taking steps. For that you may need to undergo medical examination. If the impotency is proved then the divorce can be allowed. But impotency is of several reasons. Physical impotency is to be proved. A person may suffer from impotency due to mental elements; and that is temporary which can be cured. In that case we can stick on.

It’s a deficiency of service and can be sued before the consumer court… there is proper scope that if filed and contested even compensation can be awarded… so you can darely proceed with legal measures
Q: My Husband Need Me to Give Divorce
My Husband Need me to give him divorce . He has my son with him and not allowing to see my son or talk with him . Iam ready to give divorce but i need my son to be with me . In fact the matter requires detailed discussion..we need to get the child through other legal sources, then approach the court in such a way that the custody of the child will remain with you .. there are provisions for that. Further if he files for divorce in between you need to contest it till the custody becomes clear … once the custody becomes safe, we can file to get maintenance too
