Q: Tenant is not willing to vacate the shop

Hi Sir/Madam,I own some shops in my town . As the building got older, i am planning for a new construction. But I have a problem with a tenant who refuses to vacate and he is willing to vacate as he has a demand to give the shop to him after the construction ,first of all he is not paying any rent after the covid because of his financial situation, and as a humanitarian consideration i didn't take any rent from him. I am investing lakhs of money on a new building and i dont want to give a shop to him. The contract agreement had been expired long back in 2017. Please advice

Since the tenant is not paying the rent and arrears are there you can take appropriate legal action to evict him on the basis of that . However the practicability of the same depends on Case to Case . The legal provision is there. Anyway allowing such a Cliebt to continue in nee building is not fair to business too ..

How can i get back my money?What are the procedures?If he tries to go out from this country will any issue occur to me on behalf of my money?

You can sue the person by Wat of civil suit and also criminal proceedings.. you need to have a cheque for an action under the NI Act . Once you file a criminal case, there are provision for you to issue warrant against the person . There are ways out to block his travel too , but with limited scope . It depends on the gravity of the offence

The person who met with accident is dead &Police vs Accused -Case only 341,323, r/w 34 added unbale to see any 304 A .What are the maximum legal penalties with above mentioned section .The accused was not having any insurance and deceased party Family not received any motor accident claim they dont have any interest for settlement .How to proceed .

When the vehicle caused accident doesn’t have insurance, the owner of the vehicle and his property would be liable in case if any motor accident claim is raised by the deceased persons family .. So also if you feel that they have any intention to sue, beter to settle for nominal amount and record the settlement legally.. about the sections in FIR you may cross check once more clearly

Custody of child is determined by the court considering various factors… generally and off handedly speaking you can get the custody of child as of now since the child is Do young baby .. and again it’s depended on several factors.. the right to custody can change based on circumstances too ..

Q: Easement in prior deed omitted in sales deed

Servient owner omitted easement by grant mentioned in their prior deed. While they share boundaries with me, their sale deed shown as if my entire property is in their possession . My property or boundaries shared are omitted. Under what acts can I file a suit against them and get a prohibitory injunction against them for not disturbing the easement by grant? Thank you

Easement by grant if mentioned in the prior document carries with the property irrespective of whether it is mentioned in the latter document or not .. I’m fact the seller is liable for concealing this material aspect .. but there are grounds where we can challenge the easement right .. that requires proper perusal of the documents
