Q: 25 years used path closed. its private property
is there any law that we can stop this construction?as the property is my grandpas ad its his private bt the path has been used by public for 25 years. and closed as we cant even take out our vehicles. the road starts from main road and its passes two houses and ends in front of my house. bt the whole path is private bt has been used for around 25 years
Advocate R. Madhuraj answered
Wen a pathway is in long use, the persons who use it can claim the right to use of the same irrespective of ownership .. on the basis of easement rights .. here the question is not clear .. whether you want to use it or close it ? Both can be worked out based on your requirement
Q: Sold my car to a showroom but payment not received
I sold my car to a second hand car dealer and they didn't give me the full amount for the balance amount they gave me a cheque but that was bounced due to insufficient fund. The dealer is a fraud and there have this kind of many cases in his name..And without my permission they sold my car to another person for less than the amount agreed to pay to me and they received the full amount. Can i succeed in my claim petition.
Advocate R. Madhuraj answered
Your query is not clear.. whether u just handed over for sale ? Or u signed the transfer of ownership paper and handed over ? It S not clear .. the remedy depends on that too .. if you have not handed over signed document, it is clear Case of cheating and fabrication of documents and it is a non bail able offence apart from the cheque bounce case that you can file .
Q: NRI Christian Intestate - Legal Heirs
My sister a Christian NRI, had a bought house in Kerala (Indian). She died intestate for India (British Citizen). She is survived by her Husband and 2 minor children (6 & 8).1. Who would be the legal heirs for this house ?2. Will it be Husband, Children and Parents ?While the house was bought certain amount was paid for by the father (Pension amount) and it was her desire that the house should be given to the Parents till they are alive, a sentiment that the husband agrees too.
Advocate R. Madhuraj answered
Legally the legal heirs include the husband, children and parents too .. they all entitled to the Share of property. Since she had not executed any deed regarding the property, if the parents need it for their life time, it can be done only as per the understanding arrived at between the legal heirs
Q: Unrelenting stress from spouse
.. will need check with a counselor whether divorce is in the cards ?
Advocate R. Madhuraj answered
I don’t understand your query .. you can try with a counsellor if you want to pursue the relationship.. if liking for a divorce , mutual divorce is better if both parties are ok. But if one person is not consenting you need an expert advise as how to proceed exactly . Otherwise Ul you would be in difficulty
Q: i received a divorce notice with false accusations and defaming me
we are Christians.my wife has filed divorce petition in calicut family court. i am residing and working in delhi.after delivery she refused to come back to our residence in delhi.initially she made excuses like climate in delhi etc, each time me and my family went she along with her parents screamed, shouted and verbally abused us.she has levelled serious and completely false accusations against me and my parents.it is clear she wants quick divorce but i dont want to grant it .how to proceed ?
Advocate R. Madhuraj answered
You have to attend the court by engaging a lawyer . Meanwhile you can file a petition for restitution of conjugal rights . Both these cases are counter to each other. Once it reached evidence stage you can seek a joint trial. Try to win the restitution Case , then u can defeat the divorce Case too
