Look, it is not a ground of disposal of a Criminal Case. In a Criminal Case the case may be dispose off if the Prosecution failed to submit evidence. then the Ld. Court will acquited the Accused on the ground of Non-prosecution. But Uncontested. I did not thinks so. Please apply for Certified copy of the Case and thereafter ask the question.

You have not disclosed if your friend is enlarged on bail or not. Actually in case of sessions , initially the charge sheet is submitted in the court of the CJM/ACJM. Then the case is committed to the sessions court for trial. In your friends case as there is no objection regarding the CS so it is uncontested and has been committed to the sessions court for trial.

It means your friend was served summons repeatedly and hee did not respond and as a result there is exparte order on his case being uncontested and devided by court of law.
It is better if you can go and see the court record what exactly the last order states.

Well, Police has submitted Charge-sheet against your friend in some cognigible offences of Indian Penal Code and Ld. Magistrate took conigence of the same as triable case. Sec-307 of IPC i.e. attempt to murder is a Sessions triable offence. Therefore, Ld. Magistrate transferred the case (i.e. committed) to competent Sessions Court for Trial.

In the case of sessions, the first step is to submit the charge sheet in the CJM/ACJM court. The case is then sent to the Sessions Court for trial. As there was no objection to the CS, the case has been uncontested. It is now before the sessions court.
