My friend recently got married for the second time as his first wife died 6 years back. It was a quick decision of 20days. His current wife is divorced with no child. Whereas my friend has two children, daughter age 20 and son is 12yrs. Within a month he realised that his wife is actually just opposite. Whatever she had portrayed before marriage is absolutely opposite. The compatibility level is zero. He didn't do much investigation before marriage. She has some anxiety and depression issues as well. For which she is on medication. My friend is feeling more suffocated than ever with him. Its been 3 months that he got married. But from the past 2 months he is absolutely disconnected. His wife is still in touch with his ex- husband and few other men also. And she had compared him with them once is one of the reason of disconnection. Also, she doesn't bond well with the kids as well. Pls suggest the best ground for him to part ways mutually and amicably.

If both the husband & wife are settled for a mutual divorce then it’s well and good because the wastage of time & money is less and it will be concluded within maximum 6 months. You can also go for contested divorce under cruelty. For more legal assistance I am just a call away.

Mutual divorce can be sort of both the parties have amicably decided to part ways. It’s a speedy procedure. However if she denied then your friend can file a contested divorce stating all the reason of mental cruelty and adultery. For any further legal assistance please feel free to contact

Your friend has an option to file a joint petition for seeking mutual consent divorce provided his spouse is ready for the same. Else he can file a divorce petition which needs to be contested. As you have mentioned that she is still in touch with her ex husband and few others also, your friend can file a petition on the ground of cruelty.

Mutual divorce need one year separation period from the marriage . You will collect the evidence regarding the cruelty of your wife against you . If she is talking with other man and ex husband you can take screen shot of them which may help you at the time of divorce

A simple mutual divorce can be initiated. However, the same gets tricky when people are not satisfied with the terms of separation.

A mutual divorce accompanied with a Memo of Understanding (Mou) is the way forward for a timely divorce.

If you want to initiate a divorce by trial then you may build a case on grounds of cruelty.
