Q: Selling Co-Owned Share in Leasehold Commercial Proper
Respected Sir/Madam,My sister is having co-owned - 25% share in leasehold commercial property and want to sell her share. Can she sell her share alone? If yes then what steps does she need to take? Please help. Thanks!Regards,Pankaj
Advocate Kunal Sinha answered
The nature of property is an integral question in this scenario. In the event its not easily divisible then in that case the entire property must be sold and respective shares has to be divided between the co owners. In case the co owners resist the sale then she would need to file a Suit for partition to enforce sale of he shared property.
Q: Litigating an ecommerse site that took money without delivering produc
I have a business account with Amazon, where purchases can be counted as business expenses. I purchased some equipment this week totaling about 1 lakh rupees, but an hour after the confirmation my account was blocked and money charged. It's been five days now, and Amazon has not resolved this issue, or refunded my money. I would like to file charges on a few charges - from consumer contract violation to business fiscal loss. Can someone please guide if this pursue is worth it and how to approach
Advocate Kunal Sinha answered
Amazon is a very reputed company, hence, you must pursue it legally via a legal notice and later through consumer court.Amazon has their dedicated legal team which will get back to you with proper redressal mechanism.
Q: Registering property as disputed
What is procedure for registering a property as disputed to prevent any sale of the property while court case is ongoing?
Advocate Kunal Sinha answered
The temporary/permanent Injunction has to be granted by the court, further, the case details and order can be submitted to the Registrar’s office for the record. There is no procedure as such for registering a property as disputed without appropriate court orders.
Q: Can Husband claim right of property registered on wife name.
Property of 8.5Lac as per area rate. Property is registered solely in wife’s name. {Cheque of 7.5Lac issued by me and my son and daughter}. Rest 1Lac cheque issued from husband account. Note - I myself deposited that money in husband account and i also have cash receipt signed by me.“Property price is increased now” So finally my concern is can he claim any right in my property?? Or should i make gift deed in name of my child before it??
Advocate Kunal Sinha answered
Claims can be made if he can showcase transfers in the house or plead before the court that he was a major contributor in the purchase of the property. This is relevant during Divorce proceedings.Changing the title of the property is an option but it doesn't make you immune from claims. Although, it will make his case a lot trickier. If he wishes he can still claim his shares. That's his right but but its unlikely that its going to be an easy route. Q: Want to sell property but a relative is abroad
HiWe are a Hindu family and wish to sell our property. The property is under my deceased grand mother's name. Me and my family have been residing here since it was bought. My relatives are willing to transfer it to my mother's name. But one relative is abroad with no plans of visiting anytime soon. The real estate broker adviced to get an SPA signed and couriered by him. Is there any other way? If not, then what is the procedure and duration for the said SPA? Thanks
Advocate Kunal Sinha answered
The general answer is ‘Yes’ you may. However, the SPA should be Apostilled by the Indian Consulate and then registered as well. There is no other way, in fact, its always advisable to do property transactions with the parties in person. This will ensure that there remains no ambiguity in the mind of the buyer or the owner of the property.
