What is exparte in contested divorce

I got divorce notice by husband in May 2014 but eventually I contested the same.But I was able to represent myself in court till Mid 2016 and thereafter I could not contest in court as I am out of the state.Recently in e-court status its showing eparte twice in 2017 October.What does it mean Am also now looking for the divorce. What to do now to get rid of the case. Please suggest.

The ex-parte divorce in India takes the time which is required to follow the complete procedure by the Family Court, like sending the court summon to opposite party/respondent, wait for the reply if any being filled or the service done for the notice/summon of the court sent to the opposite party/respondent.

An 'Ex parte decree' is a decree passed against a defendant in absentia. Despite service of summons, where on the date of hearing only plaintiff does and a defendant does not appear the Court.

First of all, let me know, can your husband proved his case for getting decree of divorce. If he has succeeded then you have no tension. Apply a certified copy of divorce. If your husband has not prove his case then Firstly you may contact your husband and approach him about a mutual divorce. I think he will agree with your proposal then file a joint petition for mutual divorce.

Dear Madam

All the time in E-court you will not get proper status. Ex party means one sided order delivered. For further information you have to contact with advocate and bring all papers. It is not possible to deliver all ans by writing.
