My in-laws and their family members were giving mental torture and harassments. So i asked my husband to move separately. But my husband didn't agree and left me in my parents home. Later filled a Divorce case also with lot of false allegations. Recently the case went to lok adalat and the same Judges came for it and insisted to stay with in-laws or proceed with Divorce. At that moment I agreed to live with in-laws since we were separated for 2 years already and feared Divorce may be granted if I say NO in lok adalat. But still I'm not willing to stay with in-laws and fear they will start torturing more now. Can I reuqest to live separately with my husband? What will happen if I don't go and stay with in-laws now as agreed in lok adalat? What happens to the Divorce case? Pls help.

I think on the basis of the lok Adalat you had a withdrawn the previous case so the case is not in the existence. if you feel the agreement made in the lok Adalat is violated by your husband and your facing cruelty by your inglas which is existing before filing the divorce petition then you can move your fresh divorce petition on the new circumstances before the family court if you have not completed the conditions and agreement arrived in the lok Adalat you have no fat chance to move before the Divas code nearly because of some future predictions that maybe a mental torture on the side of your due to this case it is not the ground for divorce only the actual happenings which law declares that these things are all come under mental cruelty then you can proceed you have not given the full facts and circumstances of the case so on to the extent I can give opinion

I assume that the divorce case filed by your husband is still pending. Lok Adalat cannot decide on matrimonial disputes but can help for a compromise. You can contest the divorce case based on facts. You cannot be forced to live with your in laws.

the order of loak adalat can be challenged before the high court. if you are not interested in living with your inlaws then the appeal before the high court can be filled to revise the order of loak yet another opportunity is available in the same family court.
