dear Client... Under Section 13B, when a couple files for divorce with mutual consent, they first have to establish a 12-month separation period, which is then followed by a “cooling-off” period of six months. However, the Supreme Court had in 2020 ruled that on case-to-case basis, this period can be waived need furthermore clarification pls call me E Iyappan Advocate

sir, if you want to divorce mutually you have to be seperated for atleast an year to file a case and the case will be heard by the judge only after a six months cooling period from the date of petition i.e eighteen months(18). but also this is a general rule and there are exceptions in certain circumstances where you can file a time waiver petition and urge the court to hear the matter in advance.
