Divorce matter. How to proceed ?

My husband is not replying to my calls , he has thrown me out from his house ..now he is not replying ..his relatives are also not reachable ..pls help me

Mam, being on the practical advice and to protect your marriage plz try to indulge relative's in between and resolve it before taking any legal step. In legal I ll advice you to file restitution of conjugnal rights case under Sec 9 if you are Hindu and if Muslim under Sec 2.... . best of luck for your future. Divorce is the secondary thing at this stage , you should proceed with by filing a criminal complaint as it will help u in putting needed pressure for divorce. You can either ask them for the mutual consent or if they do not agree on the same then you can also file a divorce case subsequently

Without his consent you can't take decree of divorce. You may file petition by giving his address. Court will send him notices. You may take all your grounds. You may also get maintenance. His property may be seized by court if he doesn't appear.

make a complaint to local police about your problem. then you can file a domestic violence case seeking residence in your house. you can also file divorce case on the bases of different grounds stated in act.

file Complaint with Crime against Women Cell, also file Complaint under Protection of Women from Domestic Violence Act, 2005 also can file petition under section 125 of Crpc and Divorce petition under section 13 1(i) a of Hindu Marriage Act 1955.

If your marriage is covered under Hindu marriage act then you can file a divorce petition and more over if they thrown you out from the matrimonial home you can file a Domestic violence against all the family members.

If ur husband living abroad and u r living with ur parents then u can file a case of mentenense and 406, 498A IPC and u can file a case of divorce in session court also...if u file these cases then i think ur husband will be underpressure..
