Chargesheet not yet filed by police

23-Jun-2023 (In Criminal Law)
Police is investigating my case related to cheating breach of trust etc. I am the complainant. FIR was filed by police on the orders of court 156(3) in the month of September 2020. I have heard of many cases where no charge sheet is filed by police for many years. How do I ensure that police files a charge sheet in my case. I don't want my case to be stuck with police for too long. I don't want to give any bribe ,etc. to police etc. Kindly suggest something. Thanks.

You can merely approach the police officials and request them to speed up the investigation process and file a chargesheet ASAP. If they are causing unnecessary delay in filing chargesheet then you can file an application for Action Taken Report in concerned court.

It seems that you are not satisfied with the investigation of the police and there is delay in filing of charge sheet. If the accused is in custody then police have has to file the chargesheet within 60 days so I think in your case all the accused persons they are on bail so the police is delaying the matter anyhow you can move an application before the concerned magistrate for supervision of the case so that the concerned magistrate call the record from police or the reason from please why they are delaying the matter thank you

You can file the Status Report about your FIR in the concerning Court of Jurisdiction.

The court may order concerning SHO ,police station and ask them to file the Status Report with in the time frame.

There is no time limit under section 167 CrPC for filing an accusation. This happens when the police do nothing. If the chargesheet has not been filed within a certain period of time, only statutory bail will be granted.
