Q: What to do if police is not filing chargesheet ?

Police is investigating my case related to cheating breach of trust etc. I am the complainant. FIR was filed by police on the orders of court 156(3) in the month of September 2020. I have heard of many cases where police not filing charge sheet for many years. How do I ensure that police files a charge sheet in my case. I don't want my case to be stuck with police for too long. I don't want to give any bribe ,etc. to police etc. Kindly suggest something. Thanks.

It seems that you are not satisfied with the investigation of the police and there is delay in filing of charge sheet. If the accused is in custody then police have has to file the chargesheet within 60 days so I think in your case all the accused persons they are on bail so the police is delaying the matter anyhow you can move an application before the concerned magistrate for supervision of the case so that the concerned magistrate call the record from police or the reason from please why they are delaying the matter thank you

Q: Withdrawal of divorce case by husband after 6.5 at the stage of cross

Can my husband freely withdraw his divorce case after 6.5 years of filing and without any compensation.Does undertaking of his promise to pay certain amount monthly to clear the arrears of interim maintenance and his address proof signed by wife by misconduct of her advocate help him to get withdrawal easily with cancellation of travelling expenses and no compensation for harassment for his case done on cruelty basis.

Hi you have not mentioned whether that I was petition is filed by the consent of both the parties or raising some other grounds like cruelty adultery et cetera if your husband is going to withdraw the petition it means he wants to have relationship with you he wants that you should live as a wife to him for more details please contact our office thank you

Q: Payment of building maintenance fund

I have purchased a flat two months back. Society issued a resolution in 2018 for payment of building maintenance fund- a) Rs. 80000/flat b) Rs. 5000/month for 24 months (both clauses being mutually exclusive)nRs. 5000/month was discontinued/postponed after 18 months due to covid. Now suddenly they are asking everyone to pay remaining 6 months amount. I purchased the flat two months back, am I also liable to pay it. Mutually exclusive means both amount needs to be paid or just one.

Please share your builder buyer agreement and I have to see what the clauses says in your favour if you have agreed to pay the maintenance of the building then in that case you are liable to pay so for more details please be in touch with our office thank you
