A company started with two partners, one of them is bribing the police so they don't catch him while my family member surrendered himself. Due to insufficient funds and multiple cases, he could attend all the hearings and is a PO in 3-4. The initial bail got rejected on the basis of being a PO. What should be the next step so that the bail gets accepted? The fraud is done by the partner of which we have some proofs too (forged cheques, transfers) the PO is in cases of 138 while the current case is of 420 (by the same people who have other cases of 138). How do I get my relative out of JC, it's been a month.

Hello sir. I have perused your query. You will have to make an application for quashing the order declaring you as PO. Only then will you be able to proceed with the bail of your family member. In any case the granting of bail in cases of non bailable offences under s 420 is discretionary.

a regular bail rejected does not mean you cant file it again yoy are free to file a fresh bail application to same court or higher court. just because he was declared PO in some other case is no ground to rejecting the bail application. you can get bail but you will have to satisfy the court you will not abscond and will face the trail on each and every date. for better advice you need to personally come to my office with all the relevant documents.
