After Registration Of FIR In a 420case. Police is not arresting the ac

Eighty days have gone by since the registration of the FIR. Prior to this police was also not regestring the FIR. FIR was registered on the direction of the superintendent of police.

You immediately file a writ petition seeking direction from High court to arrest the accussed person and also to investigate the case. In 420 cases the time limit for filling the chargesheet is 60 days that means the investigation should be completed in time and charges heat must be submitted before trial court within /on 60 days .Also the accussed has to be arrested . Offence under Sec. 420 IPC is a cognizable offence and police may arrest the accused. But the rule of arrest is not that straight forward, police arrests any person if that person is not cooperating with the investigation process.
And if any accused is cooperating with the investigation, then in that case police might issue a notice under Sec. 41A CrPC. Under section 41-A, CrPC, a police officer, in all cases where the arrest of a person is not required under section 41(1), shall issue a notice directing the person against whom a reasonable complaint has been made or credible information has been received to appear before him.
