Q: I made an land sale agreement but the cheque buyer gave got Bounced

I am a seller of agricultural land so I made an agreement with the buyer for the amount of 20lakhs he gave me 2 lakhs with two cheques of 1 lakh each (cheque no. mentioned in agreement) and said to deposit in the bank on Monday. but after he said me to give 1 lakh by UPI and deposit any one cheque on Monday when I deposited it into the bank it got bounced and the buyer is also not accepting calls. now I want to sell that land to another person Can I do it now by giving his 1Lakh back to him?

Hello there,Yes, you can sell your land to someone else. He has breached the terms of the agreement (contract in your case) and because of that breach you are not bound by the terms and conditions of the contract. So yes, you could sell the land to anyone.

आपका सवाल स्पष्ट नहीं है, अगर आप बेल ले चुके हैं और 482 एप्लीकेशन पेंडिंग हैं तो केस तो दर्ज हो ही चुका है। केस कोर्ट में कब पहुंचेगा - ये बात टेक्निकली गलत है, क्योंकि केस कोर्ट में ही है। बेल के बाद ट्रायल चलेगी, और हो सकता है आपकी FIR cancel हो जाए, परंतु ट्रायल कोर्ट में प्रोसीडिंग चालू रहेगी। बेल कैंसल – अगर किसी न्यायालय द्वारा जमानत दी जा चुकी है तो जमानत केवल विशेष परिस्थितियों में या जमानत की शर्तों का उल्लंघन करने की स्थिति में कैंसिल की जा सकती है अन्यथा की दशा में जमानत अकारण कैंसिल नहीं की जा सकती।

आप स्वयं यहां गलती पर हैं, नियमानुसार परीक्षा में बैठने के लिए अटेंडेंस आवश्यक है, जबकि आप रेगुलर क्लास जाते नही हैं, ऐसे में किसी प्रकार का करप्शन आदि का केस अगर आप करने का विचार बनाएंगे तो इस बात का ध्यान भी रखिएगा की आपके द्वारा फर्जी तरीके से बिना क्लास में आए उपस्थिति लगाई गई है। मैं आपको इस प्रकार के केस करने की सलाह नही दूंगा और अगर आप अतिरिक्त पैसा नही देना चाहते तो रेगुलर क्लास जाएं, और उसके बाद कोई आपसे पैसों की मांग करे तब आप शिकायत कर सकते हैं।

Hello there,Cruelty is one of the big grounds for getting the divorce, cheating/stealing etc would fall under that category only. But in your case the situation is different as you were in need of the money, and due to that you sold your jewellery, this is completely normal and cannot be considered as theft or cheating at all. There are two reasons for this 1) you were in need of the money and if you could produce the evidence before the court that there was some sort of requirement of the money then there will be no adverse effect on your case. 2) the jewellery was yours so no point of asking for permission or letting your in-laws know about the money/jewellery. There is a clear rule that all the jewellery and other things which the women received during her wedding will be considered as her Stree Dhan, and she has absolute ownership of the stree dhan. So this ground alone will not be enough.

Hello, Although one can file the FIR at a police station other than the original jurisdiction police station, this type of FIR is known as zero FIR but eventually this FIR gets transferred to the jurisdiction police station, so in your case even if you file/register the FIR in Bhopal PS then also the case will be tried in Bhind Magistrate court only. So I would not suggest you file the FIR in Bhopal PS.
