unable to make ROR ?

my grand mother purchase land in my father name from 3 brothers belong to ST caste with permission order from sub division tahasildar in 1974. unfortunately we unable to get the ROR in 1975 settlement due missing of sale deed and permission copy. Now I file a suit in the court for ROR with the original sale deed and permission copy. Can any one of the three brother or their son or daughter make objection in the court against the sale deed or permission order.? if yes on what ground they make objection?

At first I would like to know when the sale deed was executed in favour of your father, he was a dependant or a earning person. And more over whether the land was purchased out of the earnings of your father or was purchased out of the earnings of the joint family.

If the land was purchased out of the joint family earnings then your father's brothers are entitled to get their share.

As per the OSATIP 2/56 regulation you have obtained permission order from the Sub Collector for purchasing the said land. If you have the said OSATIP case number you can obtain the xerox copies of the sale deed and Ror. By virtue of the xerox copies you can apply for a certified copies of the sale deed and Ror.

They have one ground of joint property sale deed manipulatedmBut not maintainable since permission is in your name.You can defend any objection in the court of law.please meticulously pursue civil suit.

Under the regulation 2 , purchase of st land must be notified before the sub collector and civil suit is not maintainable as per the provisions of the said act . If you are in possession of the said land then approach the sub collector or file writ in high Court

Was the plot in 3 brothers name ? All must have signed the sale deed . U can ask for a certified copy of sale deed and verify at RI office the records of flow of property to them .Even if they object ,it won't stand
