Q: Regarding residential certificate
Hi, I am staying in Bhubaneswar on rent since last 7 years. Can i get a residential certificate from the respective Municipality. What are the document required for that.
Advocate Rajendra Kumar Senapati answered
Residential certificates are issued for certain purposes. Residence certificate can be issued as per your stay at one place. If it is for employment your stay should be for 12 yrs. if it is for marriage one month of residence is sufficient. For further assistance you can approach the nearest Common services centre i.e., Jan Seva Kendra. They will assist you and ask the required documents.
Q: Building quality poor and amenities not provided how to do sue builder
I bought a flat 4 years ago. Proper possession is not given till date although I've keys and access to flat. The build quality is very poor (water seepage since 1st day, cracks, woodwork so poor that doors won't shut) and builder did not rectify them even after several pleadings. Builder also did not give the promised extras like community hall/gym/swimming pool/children's playing ground etc. How do I go ahead and sue him in rera court?
Advocate Rajendra Kumar Senapati answered
Sir basing on the sale agreement executed between you and the builder you can approach the local consumer forum for proper justice. You can file an application u/s.12 of consumer protection act before the consumer forum under deficiency of service.
Q: Complaint against builder for not providing sale deed
SIR I HAVE PURCHASED A FLAT WITH 30LACS FROM A BUILDING WITH THE HELP OF SBI HOME LOAN. SBI PAID 23.5LACS(LOAN AMOUNT 26LACS) INITIALLY TO BUILDER AND BALANCE WOULD BE PAID AFTER HANDING OVER SALE DEED. BUILDER REGISTERED THE PROPERTY WITH 23.5LACS INSTEAD OF 30LACS CONSEQUENTLY BANK NEITHER GIVING BALANCE AMOUNT TO BUILDER NOR ACCEPTING SALE DEED. PLEASE ADVISE WHAT TO DO AS EMI DEDUCTING FROM MY ACCOUNT
Advocate Rajendra Kumar Senapati answered
Generally what happened as per the government valuation your sale deed was executed. But whereas in odisha the market price and government value differs the bank pays the loan value as per the sale deed executed. Though the market price of the flat is more, the builder executed the sale deed to avoid excess stamp duty and registration fee.
