partition suit and seeking permanent injuction.

In our partition suit in adj court .We forget to file some of important document because of poor quality of lawyer.and result we defeat in the case . Now we appeal in high court against order and high court given stay that trail court is free to proceed further but shall not pass final decree in the matter .So sir now how we give the document to court so that decision and preliminary decree get quashed.is we can give application in trail court for document.

This happens many a times that due to inadvertance some important evidence remains out side of the filing, there are provisions available in cpc, one can do it by filling separate application for this purpose. Your advocate will suggest you and if you are standing on better footing you can have case in your favor

If you have forgote to submit few documents along with your plaint than now also you can submit these document before the trial court along with application under order7 rule 14 cpc and that will be accepted if your evidence has not completex still. Your appl. May ve accepted on cost also

my dear friend, Civil Procedure Code 1908 provided order 41 rule 27 for adducing additional evidence, in appeal. after satisfaction of the court that concerned documents was not within its knowledge and is very relevant to decided the matter finally for justice. but lacuna cannot be fillup. all depends of facts.
