dispute with the neighbour over boundary wall

14-Jan-2023 (In Civil Law)
We have built an independent boundary wall around our house . My neighbour has filled in morrum in the gap in between the boundary wall and also the drainage water of kitchen and bathroom keeps on seeping into my boundary wall. We have told this problem to our neighbour but he dosenot listens instead he abuses a lot. I can't let my boundary wall collapse because of recklessness of my neighbour.i want a legal solution of my problem. Kindly advice what type of case can I file against my neighbour and how can I save my wall. Everyday we have argument or verbal spat over boundary wall. Their tenants use our boundary wall to dry their clothes and keep their cycles by taking support of the wall. I have told them clearly not to do so still they do not listen and keep their cycle against the wall. I can't tolerate abuses everyday.please help.

You can file a Civil Case against your Neighbor for not encroaching and using your Boundary Wall. You have to collect all the evidences against your Neighbor before filing case against him to get him criminally prosecuted.

What are the rules for boundary walls in India? In India, if a 9-inch boundary wall is built, 4.5 of the inches will be in your plot. The remaining 4.5 will be in your neighbor's plot. Each plot owner is entitled to 50% of the wall. The wall is built by the first person who begins building a home.
