College denying admission even after paying partially what to do.

13-Dec-2023 (In Civil Law)
Sir, I would like to bring under your notice that I have given a blank cheque to a private college for B.A.M.S degree course and given verbal instruction to produce a cheque after 10 days and he issued against that a bonafide certificate for admission in 1st year course year'16-17, but they have produced the cheque immediately and cheque got bounced. There after college has said, transfer the money through RTGS or NEFT within 10 days and They have confessed by mistake it has been produced to your bank. Initially I have transfered amount of Rs.50000/=out of Rs 2 lac to cheque whether it has been transfered or not. when i inquired the same to the college authority then they said I have sold the same seat to others on higher donation and refused to give an admission. What I should do? kindly advice.

You can file a writ petition challenging the denial for admisson Keeping bonafide certificate issued by them to you.
Further you have not made any mistake on your part
You have good grounds to file writ
Cheque presented earlier inspite of your instructions
50'000/ paid by you
They can't cancel your admission unless you denie for payment.
You have not denied to make payment
Partial payment already paid which shows commitment towards seat
Institution owes liability to give seat as promissory estoppel binding on it
Only right for institution is to claim admission amount.

Proceed to file a writ

Initiate action under the civil remedy by filing a suit for damages and as well as under consumer protection act. Since you have transferred some portion of the amount to the college, ypu have not said anything about the money transferred whether you have received it or not is not said.

You are required to give a police complaint narrating the entire episode in detail date-wise. The college is indulging in malpractice. If the police does not help, then file a case in court of law seeking direction for the college to give you admission.
