Q: What are the consequences of not receiving a court notice sent by Registered Post with Acknowledgmen

What are the consequences if I do not respond to a notice sent by Registered Post with Acknowledgment Due (RP AD) but it remains undelivered? Additionally, if I am aware of the contents of the notice, can I reply directly by denying the contents, or is it mandatory for a lawyer to handle the response?

It is better to give a reply through an advocate only. Because you may feel so many points important and in the rush of giving the reply you may disclose certain vital points which according to you may find very trivial. So it is better you give the reply through an advocate only

Q: How to report a rooster in a residential area as pets by neighbors?

Hi, Needed your suggestion for this situation. A house across my apartment has over the last couple of months, started keeping roosters and hens as pet. The roosters as they start crowing very early in the morning and keep doing that during the day. There are at least 4-5 big birds visible in the open lawn of the house. n winters, since fan is off and there is more silence, the damn bird sounds like crooning right in the room! This has now has become a great nuisance. I am waking up everyday at 4:30-5:00 am to disturbed sleep. Requesting an opinion on- is it legal to keep chickens in a residential area?, if there is any law restricting domestication of pets (specially roosters) in residential areas or any other recourse for reporting this in local police station. Thanks.

You can sure file a suit seekinf relief of injunction against the owners of the pets. There is no stringent law that prohibits cultivating pets. However under the facts and circumstances of your case it is advisable to file a suit for injunction.

If it is your own land then you can file a suit for declaration of pawnshop in so far as the land in dispute is concerned. However if you were know adverse possession in any of the land belonging to government then I think you have to file a suit seeking relief of adverse possession.

Q: Case filed by bank for fraud even after repaying money

I was working in Grameen bank and I made fraud in bank. But I repayed full amount of the fraud amount back to the bank. But bank filed case against me and it is still pending in the court.

The mode of payment if money to the bank and the acknowledgement from the bank to that extent should be produced to the court along with a memo and state that the matter is already settled between the parties and since there offence is compoundable the complaint be dismissed. Or else file a 482 petition before the high court and get the complaint quashed.
