Claim for ancestral property after 12 years

21-Apr-2023 (In Civil Law)
Hi, My father purchased a property in 2014 from a lady (Mary). This property was in turn purchased by Mary from one Mr. Sanjeev In 1990. This person Sanjeev got this property from his father and is an ancestral property. Now when we are in the possession of this property Mr. Sanjeev’s two sons (Ravi & Sashi) are sending us the lawyer notice claiming that this property was sold to Mary without their consent & are expecting some settlement/claim from us. Till this date that is since 24+ years they were quite & did not ask form any claim with Mary & now they want us to settle, pls guide.

Dear Sir/Madam, you do not reply to this legal notice, if you are reply the notice you are committed. You kept quite, don't answer to this legal notice. If they have filed any case in civil court at that time you have to appear before the court and to contest the case by way of filing written statement as well as objection by engaging a counsel from your side. If you want more legal advice in this regard, I will do it because of it is very sensitive and tackle the matter to save the property in legal way.

Hi
If the Persons claiming now were minors at the time of sale and if the property is ancestral they may have a share in the property, however, see that if the minor attended major and set aside of sale should be filed within 3 years, after attaining majority, if not this is barred by limitation, however seek a lawyers help and send a legal notice or reply notice rejecting thier claim.

From your question it is clear that , it is an ancestral property. Your father purchased it from Mary, who had purchased it Sanjeev who got this ancestral property from his father.
When it is an ancestral property everybody has got their share. In this case Ravi and Sashi can claim their share in the share of their father in the ancestral property.
