Ancestral property after partition becames self acquired

27-Oct-2023 (In Civil Law)
Good morning sir, I had a query that my great grandfather had 12 killas of land which he divided among he 2 sons by means of release deed into 6 killas each. My grandfather got 6 killas of land after partition , now in 2014 my grandfather made a release deed in favour of father for that same 6 killas. Now my father’s sister filed a case in the court demanding her rights in that property. Does she have any rights over our property? Also my grandfather disowned her by means of public notice. Also I have heard that ancestral property after partition becomes self acquired , the share each coparcenor gets. Please help me in this regards.

if the property was partitioned by your great-grandfather, it would cease to be a HUF property and the share that your grandfathers received would be treated as self-acquired property after partition. therefore, your father too received the property as a self acquired property. moreover the fact that your sister was disowned by public notice, further strengthens your claim to the property.
