Q: What are the legal consequences of a cheque bounce due to signature difference ?

Hi, i want to know whether i can put a case against the cheque bounce case under negotiable act 138 when the cheque is returned with reason cheque bounce due to signature mismatch

Advocate Rajeev S Vadrali answered
You can not file a cheque bounce case for the reason signature difference. The said reason does not attract sec.138 of NI Act.on the reasons mentioned in the return memo i.e, Account closed, insufficient funds and other reasons, you can file a criminal case u/s 200 of Cr.P.C. r/w sec.138 of NI Act



Q: Procedure for Changing Caste Name in Transfer Certificate (TC) of School: A Guide

In my Transfer Certificate (TC), my caste is mentioned as Mudaliyar, but I need to change it to Agamudi Mudaliyar, as it appears in my father's documents. They are requesting a High Court order for the change. Whom should I contact to proceed with changing the caste in the Transfer Certificate (TC)?

To change your caste, you will have to file a suit for declaration and mandatory injunction against the State Govt., represented by Dist., commissioner and Deputy Director of Public instructions.Before filing the suit 60 days legal notice us/ sec.80 of Civil Procedure code will have to be issued to the above said . After 60 days you can file a suit.

To get the order sheet you will have to file an application for certified copy. You will have to be identified by an advocate, otherwise you wont get certified copy of the order sheet. If you have already appeared in the case then your advocate can give an application for certified copy of the order sheet.

I had given money to a person and he has given me posted cheques. When I produced the cheque to recover my money. The cheque bounced with insufficient funds. I want to file a case and recover my money now. How long will it take in the court for settlement.

It cannot be said that how long court will take for settlement. It depends on the pending cases in the court. If court is rush it may take time, if not then it may take less time to dispose the case.Before filing the case u/s 138 of NI act procedure has to follow, if not case will be dismissed.

My father made house WILL from his name to my mother name .I have one younger sister and I am demanding my mother to divide the property to my sister and me. But my mother don't want give me property and want to give full property to sister. Can I go legally and get property share. My father got property from his grand father as WILL. And my father support to me.

If it was your grand father's self acquired property and your father that property thru., will then it amounts to your father's self acquired property. Your father has got right to transfer it to anybody thru., any means. By virtue of will your mother has become the absolute owner of the house, so she can give it to your sister. You cannot claim share in that house
