What is the validity of divorce on notary paper
20-Jan-2023 (In Divorce Law)
in 2012 me and my wife mutually decided to get separated. we got a notary paper made and signed that paper and agreed for divorce. I am married to another woman now, and my previous wife has also remarried. My question is that is the previous divorce done on a notary paper is valid?
The only way to get divorce is by filing divorce petition in family court, however consent term can be written and notarised but only that paper is not enough for divorce. Judgement and decree of court is compulsory for marriage be dissolved.

Is a notarized divorce agreement legally binding?
The separation agreement becomes legally binding once both parties have signed it and notarized it. It can then be enforced by the court. The court may enforce the agreement if it is part of a consent agreement as part of your divorce. 05-Mar-2022
Can notary argue in court?
A: No, not as a public notary. In India, however, only lawyers are notary publics by law. It is not a bar to him practicing as an advocate. A notary public cannot represent a client unless he is also acting as an advocate.
Is a notarized agreement valid in court?
Document Notarized
Signed by a Notary, the document is valid. The Notary verifies that the signatures of the signatory and the witnesses are on the document. It may become valid, but it is ineffective as evidence. The law considers it valid for three years. 18-Jul-2023

Hi Divorce on notary paper is not valid , both of you can file a Petition for mutual consent divorce which will be granted after six months . Hence the second marriage by both of you is not valid till the dissolution of first marriage legally by a Divorce Decree by Family Court.

Hi
The divorce paper made by notary is not permissible in law therefore it cannot be said that you have divorce your wife legally.
Validity of that document is very negligible if it is called for evidence in the court.
