No validity of notarized divorce deed unless court grants you divorce by law.. You have to file petition under section 13B before district judge. Otherwise your divorce is not valid and you will be assumed as married

The agreement does not hold much ground as a preliminary opinion. I would like to see the agreement first before commenting. Also, it seems the agreement is about filing a petition for mutual divorce. If you are not following it by not giving divorce, then you cannot claim that he will follow the agreement too. You both can file cases against each other.

First of all main aapko batadu ki 13 B under hindu marriage act 1955 ki petition court mein dono husband and wife ek satk dalte hai. Iska matlab hai ki dono ek disre ki sehmati se divorce le rahe hai. Jaisa apne bataya ki apka notary divorce hua aisa kuch legal term mein hai nahi divorce dene ki power sirf court ke paas hai and ek baar divorce grant hua to aap dono ek dusre par case nahi kar sakte.

Yes, your husband can take his legal remedies if you will back out from the comproise deed without any cogent reason. You must have some valid readon to do that. Rest talk to your laywer who is dealing with your case.

He can file a divorce case on some other ground apart from mutual consent. But no other case as such. You can always deny the said agreement it will not stand in your way. Also you must file a suit for maintenance if you are living apart from your husband . It is your right
