Seek divorce from wife due to infertility and incompatability issues.

We both are Hindu and her ancestral home originally from WB and mine is from Bangladesh. Its been, 8 long years that we are trying for baby and I have taken her to different hospitals, treatments etc. but she is not able to conceive yet at her age of 38. She is having infertility problem and not sure her sister might also got divorced based on the same reason. I'm really frustrated now and we are fighting almost everyday based on this issue and want to live alone now. Sometimes she agrees to give me mutual divorce and sometimes asking for compensation. Hence, need a consultation from a lawyer if I can get divorce based on this issue and how much would be the cost and best possible path for this.

There are two tyoes of divorce, contested and mutual. I want to hear your story in full. I meed all the details, if required I will like to sit with you both once also. But as of now I can only say that its always better to go for mutual divorce and I will strive for that only.
The cost can be decided only we decide which divorce we are going for.

If you are very sure that you want a divorce the best way would be if your wife agrees to give you a mutual divorce. Otherwise you have to file a divorce petition for contested divorce which is consume more time and money.

Infertility itself is not a valid ground for divorce. Best short-cut is to file a petition for mutual divorce. In that case 1st you have to live separately for at least 1yr. from each other. If you can amicably settle the matter between yourselves question of compensation or maintenance would not be arise. Otherwise, Minimum separate living (desertion) of 2yrs., Physical & mental tortures, adulterous living of either party, give up his/her own religion(Hinduism) etc. would be just grounds. In that case your wife can demand alimony/maintenance.

My first question to you is do you have medical evidence that your wife cannot produce a child. Moreso, do you have evidence whether you are capable of producing a child. Moreover if you say for this ground you will file divorce your wife will manipulate the same and state lets adopt and such thought process of yours is unjustified. You have deal this calmly and tactfully otherwise you will be badly trapped in a legal battle. If you file contested divorce you have fight it out totally or if you can bring your wife to an amicable settlement and ask over mutual divorce. A lot of things need to be taken into the account before jumping to conclusion. It is not a ground for divorce.Detailed meeting over it is necessary to figure out ways.

If your wife is agree to take divorce then you can file divorce by mutual consent and one lumpsum amount you have to give for once and all. And if she doesnt want then you have to file a divorce petition against her and for settlement of amount which she will be demandning from you yhen you have to contest that case.the total cost only for mutual divorce would cost you around 20 k.
