Questions Answered by Advocate Debangshu Dinda

Q: How to speed up a property dispute case

we have a property dispute going on for few years at District court of west bengal. we are hindu. To get the justice faster, how can we move to Kolkatta High Court ? Thanks

Advocate Debangshu Dinda answered
First I need to know, what type of case is going on in High Court. What is the stage of that proceeding. I need to see what pleadings have been filed in the said proceeding. Only then can i say how to proceed to High Court. But generally, it is advised that if you want speedy disposal then you can always file a civil revision for expeditious disposal of the proceeding. But I will not commit on that. First I will see the papers and then only I will comment. I tried to give an overview. New possibilities can be worked out once we sit with the papers and I come to know, what exactly you want. I have an office opposite to High Court. My contact details are available in the site. Feel free to get in touch.

Q: Insurance agent denied claim based on heated argument what to do

Bought zero dep insurance from ICICI lombard. My car met with an accident. When i asked for insurance claim a heated argument happened with the insurance agent. Now they have denied to give me insurance claim when the bill is raised. What to do?

Advocate Debangshu Dinda answered
Sir, inspite of availing a zero dep insurance, there are certain things which are required to check. I also need to know certain things. FIrst get your car repaired. Get the bill from the authorised service center and then we can draft a notice and proceed accordingly. I tried to give an overview. New possibilities can be worked out once we sit with the papers and I come to know, what exactly you want. I have an office opposite to High Court. My contact details are available in the site. Q: Can civil construction be stopped by local police under section 144 ?

Can civil construction be stopped by local police under section 144 ?

Advocate Debangshu Dinda answered
Sir, First I need to know, is the construction made in your land ? How are you affected by such construction? Only then, I can give you a concrete advice. Because 144 only directs the police authorities to take care of the fact that law and order in respect to your possession is not hampered and the police authorities are directed to file a report. But I dont think it will really help you if you want to put a spanner in the wheel. For that you need, specific case made out within the scope of civil laws, before the appropriate civil court. I tried to give an overview. New possibilities can be worked out once we sit with the papers and I come to know, what exactly you want. I have an office opposite to High Court. Q: Can a woman ask for divorce on the ground of mental harassment

Respected sir, My sister have female baby of 2 years. My sister is unhappy with her husband. Her husband always under estimate and temper on her. My sister never say anything to us. Now she is bound to leave her home and come to my home. Her baby they kept. My sister always compromise with her husband. Her husband mentally harassed my sister. My sister now very depressed due to her baby. Kindly help and advice me what I should do as a brother. Our religion is Hindu.

Advocate Debangshu Dinda answered
Madam, The facts you have stated is very fragmented and precise. In case of matrimonial disputes, we need to know every detail of information before we strategize anything. We can sit and strategise the next course of actions. But yes, I will always like to advice you on certain things on the assumption that your brother-in-law is not agreeable to mutual divorce. 1. Immediately file an Interim maintenance petition along with a divorce petition. 2. File an application for custody, as your child is of 2years, your sister can always get custody, subject to certain conditions. But whatever we have to do, we have do it quickly. I have an office at High Court and I stay at Rajarhat, New Town. I generally don't conduct conference in New Town but if have issues in travelling, I can accommodate you.Feel free to contact.
