Petition under special Marriage Act for obtaining decree of divorce can be filed in your case. If its a mutual consent divorce the petition under section 28 of special Marriage Act shall be filed. In case if it's going to be a contested divorce the petition under section 10 of special Marriage Act shall be filed in a competent court having jurisdiction to entertain the petition.
