I received a family court notice

Matrimonial Question I'm Hindu by religion. My wife's family have filed an petition in Mysore Family Court, for which I've received an intimation from the court to be present on 10th April 2017, without giving me any details of the petition or charge. In the notice its just mentioned M.C 122/17. Q1. Is it mandatory to be present in the court on 10th April? Can I wait for an second notice. Q2. How do I know the details of the petition & the charge booked by the court as the notice doesn't provide any details of the petition.

In this case as the petition copy is not sent to you along with notice, it is better you attend the court and obtain the petition and then verify and file your objections and proceed with the case with assistance of advocate, you have to be present on first date where normally conciliation takes place.

No it is the court notice and you should attend the court and request that you are not received the petition copy. The court will direct the petitioner to furnish the copy of the petition or if there is extra copy court will difinatly give you

Once the notice is served, and if you failed to appear, the court will not issue another notice. it will place you exparte and proceed with.

appear and file the necessary objection to the petition if required. Other wise it will be presumed that you are admitted the contents of the petition.

Hello Sir,

Yes you need to be present on 10th April or you can hire an Advocate to be present on your behalf, but you need to be present there. Hire an Advocate to take up uour case and answer accordingly.

You have to fight out hard for it and have to take a chance that too with Advocate having legal expert or else have to be subdued with order , you may contact or consult for better legal advice .OFC : Adv pankaj Kumar & associate,

the court will not issue second notice. you have to appear on the said date yourself or take help of counsel and collect the paper. if you failed to appear the court will pass the order hearing one side.

Return of Notice means that the court has sent a notice to the defendant to be served and is now waiting for it to come back with a report on whether the defendant received or rejected it. The purpose of a summons is to notify the other party of a civil lawsuit filed against them before the court.
