Q: Transfer of divorce case from one district court to another taluk court by order of PDJ

Matrimonial case filed by husband in family court against wide for divorce ,wife residing in another taluk can she file for transfer in principal district and session court to transfer the case to her taluk where the principal civil judge court is there ,my doubt is as family court is of district judge cadre can the case on the file of family court be ordered to be transferred by pdj court under sec 24 of cpc, how to transfer divorce case to another court ?

Respected She can seek for transfer but only before the High Court. District Judges do not have any power to transfer the case. The person who intended to transfer, move the necessary petition before the high court and seek permission . The High Court only having the power to transfer.

Q: Procedure for cancellation of decree cpc obtained in property suit

the plaintiff (legal heirs )of deceased grand father and defendents have obtained fraudulent decree in the absence of title to land measuring 3acres in 2008 without to our notice. My father was killed by the defendent for filing complaint against the alleged defendents in jan 2018. The plaintiff grandfather has sold the property in year 1938. the plaintiff (legal heirs )of deceased grand father and defendants have obtained fraudulent decree in the absence of title to land measuring 3 acres in 2008 without to our notice. My father was killed by the defendant for filing complaint against the alleged defendants in jan 2018. The plaintiff grandfather has sold the property in year 1938. Both the advocates and the clients in fraudulent decree case are under knowledge of sale of the land to my grand father. How to cancel the fraudulent decree and where , limitationSir you question is not clarified. Please confirm that in whos possession the land is there. I received a summons and a petition filed by my wife from the court, stating I need to attend a non-mutual divorce case filed by her. However, the petition is not signed by either the petitioner or her advocate. The summons has a seal, signature, and MC number, but I doubt its authenticity. Respected Please go to Family Court and search in the computer there and also make inquiry at office of the court. When there is seal and sign and MC number on the summon that itself mean that the case was registered. She had filed contested divorce case. Please attend on the date mention in the Summon.
