the best thing you can do is file a criminal case under 498 A in police station and also file a case of domestic violence against your husband and in laws and as for seperate residence, or for seperate accomodation in same house and also ask for maintenance and other reliefs which you require.

Q: Divorce over wife’s short temper

My wife has anger issues and we have been living separately for 13 months after I discovered she fed me viagara pills without my notice (understanding the side effects) out of desperation or anger. She talked bad about me to my friends behind my back. Within this one year of separation we had minimal conversation and we never took initiative to make things right. Can I initiate the divorce based on anger issues? I have the conversation recorded where she acknowledged everything and more.

yes as you said if the anger is showed everyday and even for small issues and if without your knowledge if vaigra is fed to you it certainly is cruelty caused to you and hence you can file a petition for divorce on ground of cruelty and get divorce.

The laws which mostly help husband are to take prompt action by filing cases like restitution of conjugal rights, divorce or issuing legal notice and representation in proper way to the cases filed by wife or husband, and also seeking assistance of elders, conciliators or mediators to solve the issue at the earliest.

Q: Income incurred from ancestral property

My mother's father passed away 10 years ago. My mother has two brothers they are giving some or the other reason and not dividing ancestral property from past 10 years. And they are only keeping all rental income from that property (approx 30 lakhs rent incurred in 10 years). Can my mother claimthat rent money during property division?

The only remedy for your mother is to file a civil suit for partition and seperate possession, for you can file a application to deposit the rent in court and to disburse it only after decision of the court as to who is entitled for what share, further you can obtain an injunction order not to alienate or create an encumbrance or raise loan on the property till the decision of the case.

if you have purchased property out of your own funds even the statement of mother will not help them, you do not have to give anything to your brother or mother, further if you have source of income and you can prove that the said property is purchased out of your own funds it will further strengthen your case, hence you are not required to share anything if it a property purchased out of your own funds
