Can we do the partiton deed as : Property A shall belong exclusively to the Elder Son.Property B shall be jointly owned by the Elder Daughter and the Elder Son.Property C shall belong exclusively to the Younger Son.It is expressly agreed that Property D, which is already in the name of the Mother, shall not be part of this partition deed, and the Mother shall retain sole ownership of Property D without any claims from the other parties herein.

yes you can very well execute a registered partition deed and two witnesses must be there and get the said partition deed registered, there is nothing that prevents you from execution of partition deed.

The Husband was working in Bangalore and the Wife was working as a consultant in the US. At the time of wedding, both were Indian citizens. In 2011, the wife became a USA citizen but husband wasnt aware. They had a mutual understanding that the wife would shift to Bangalore but didnt happen and there is a child born out of wedlock.They stayed together for only 20 days a year from 2004 to 2014.After this there has been no communications between them. yes it is possible to get divorce within 10 months, firstly you have seen under which act the marriage has been performed whether under Hindu marriage act or special marriage act and accordingly you have to file the divorce petition before the concerned family court which has jurisdiction, further if both parties are ready a mutual divorce petition can be filed, as there is breakdown of marriage it is possible to get divorce.

We have a joint property ( our house) which our relatives sold their shares to builder without partition and also never told us that they are selling.Can we save our house from builder

yes you can file a suit for partition and also obtain a stay order not to sell further or make any changes, construction or raise loans ob that property and you can also ask for the relief to declare the sale deed executed by them as null and void.

My wife left me after few months of my marriage and then filed sec9 on me after one year she left. At same time I filed sec13. Counseling failed. She about to file MC, working women. I have no property but my parents had properties, we are building house with my loan. How can I counter to MC file?

as per the present law both the husband and wife have to furnish affidavit of assets and liabilities and also furnish everybit of information of income, loan, dependents, health issues, etc then the court will decide whether she is entitled for maintenance, further you can take a defence that she is earning more then you and she can maintain herself, and she has left the house without any valid reason hence she is not entitled for any maintenance.
