Tenant staying in property from 6 years not paying rent

we have a flat on rent which is in name of my father, unfortunately my father expired six month ago, now our tenant is acting up and has refused to pay. making up stories like your father took 10 lakh as loan from me and things like that. what can we do? he is staying in property form last 6 years and father did rent aggrement for one year only, we dont have that document either. property is a flat in a co-operative society. what is the best option we have to make him pay or get the property vacated.

U can file eviction petition to rent controller although u don't have any legal document qua to prove that he is a tenant ... because there is also chances of oral agreement of tenancy .... u no need to pay him .... litigation may take time but atlast u get your property back

The best option to evict the tenant is the eviction of tenant on the ground of self need / bonafied need in the court of rent controller by filing a suit for eviction against tenants. This is the best ground for the speedy justice.

File eviction petition on the basis of non payment of rent and personal necessity. But, it has to be filed by real or present owner only. Also, you can file criminal complaint in case he threatens you in any case.

My dear friend, you are the owner of the property and you have every right to get the property vacated. You can file eviction petition to get the property vacated. Kindly reach to your respective district court at the earliest and engage a lawyer and get your legal action started or you can ask LawRato to help you engage a lawyer.
