Q: if the marriage is done by Hindu rituals and ceremonies but it is not registered in any court or leg

if the marriage is done by Hindu rituals and ceremonies but it is not registered in any court or legal authorities and more over husband wife is not staying together for more than 4 years due to husband's misconduct and poor character, is this marriage valid ? and is there need to file divorce?

Advocate Pankaj Chauhan answered
Absolutely!Non-Registration has nothing to do with validity of marriage. Though you can very well apply for divorce on the grounds of desertion. But filing of divorce case is mandatory. I hope my answer met your query.

Q: Mere husband foreign m hai, na mujhe calls karta na koi reply

I got married in 2021, mere husband foreign m job karte hain, but aajtak usne mujhe apni koi details provide nhi ki, na mujhe apne india aane r jaane ki koi information deta hai, na mujhse milta. Meri nokari chudvayi, servent ki tarah treat kiya, father in law hamesha batmeezi n abusive language use karte, infact koi personal life nhi. Beta marriage ke 20 days baad foreign vapis chala gya r iske parents ne badi batmeezi se meri saari jewelry mujhse le li. Mere husband ne marriage ke 2 nd day hi mere Shagun ke paise r mere bank details ki demand ki. Husband ke paise pe sara control father in law ka rehta hai. Beta har galat baat m father ko hi support karta hai. bimaar hone pe na kuch khaane ko diya, r next day mujhe mere ghar chood aye. beta meri calls attend tak nhi karta na koi reply karta hai na uske parents call attend karte hai na uski koi information dete hain but last year se mujhe r meri family ko badnaam kar rhe publically. Mujhe financial support bhi nhi mil rha husband se.

Better get an FIR registered before its too pate. File suit for maintenance. Ultimately they are giving maltreatment to you and you or any woman doesn’t deserve it. If you want to know any more then feel free to contact.

Q: Threatening and Disruptive behaviour by an Individual

My father and mother are retired class 1 officer and we have been a victim of hooligan behaviour by an individual, who has been harassing and intimidating us for quite some time now.First incident took place on 12th January 2010, when my father and mother were going to the government job (they worked as a class 1 officer in civil surgeon hospital) and Mr. Raj Singh followed their vehicle stopped their car forcefully and started hitting car window and threatening both my parents. We have reported this incident to the local police on 13th January 2010 but no actions were taken. Now, recently my father was going in a car with his friend, when they were stopped by Mr Raj Singh on 29th January 2023 and he came aggressively approaching towards my father with the brick in his hand and threatened to smash the car window. This repeated threats and malicious actions have left us feeling threatened and distressed. Would it be possible to re-open our complaint made in 2010?

Advocate Pankaj Chauhan answered
See re-opening old complaint wont help. If at all you you open an old case you case would lack evidence and fresh investigation wont be of any help. Better I advise you to file fresh complaint and mention about previous incident also and also state that your family’s life is in danger and ask for registration of FIR against him. Anything more then feel free to contact.

I am sure you have a phone. You can call police for help. That is instant remedy. Once you move out you will have plenty of options to look upto. Better call police then move ahead for taking divorce or child custody.
