How to stop illegal construction

29-May-2023 (In Civil Law)
My neighbour was performing illegal construction on govt. street, which left street distance of only 3 feet. In my house registry this distance is 12 feet.We informed the municipal corp. but no step was taken due to corrupt officers. My neighbour started const. on saturday evening , we inform the police but no action was taken.so we stop the const. ourself. But they record our footage of stoping the const. Other main thing is that the place we want to stop const. is govt. street and intially old constructed before we come to this place. Now he is building new on this old place. Please tell me what to do, can a court's stay help us as it is old or municipal corp.

You, alongwith other members of the society, can file a suit against the encroacher as well as against the municipal corporation for not giving any heed on your genuine request, in public interest in civil court, or you can move an application Under Section 133 Cr.P.C. against the encroacher for causing public nuisance by encroaching the public street.
