BDA acquired farmland but did not allot BDA sites as promised

28-Mar-2023 (In Civil Law)
Hi . My query is BDA had acquired my grandfather's farm land of 3 acres during 1990s.It was promised that they would allot BDA sites in place of that acquired land along with some compensation. We have received the compensation amount but we haven't been alloted the BDA SITES promised. So regarding this my grandfather had signed agreement with his brothers son saying that he has given him rights to walk around for allotment and get us the sites alloted this is been more than 8years ever since he signed the agreement but we have not got any sites alloted yet when we enquire about he escapes saying there are cases in court against acquisition of the land alloted to us. But when ever we ask him to show the case details he will just deviate us.my grand parents are old with frequent health issues and hospital admissions. So we thought we will look into the matter personally but my grandfather's brother's son is refusing to give the details.what can we do now.Our worry about agreement

I will tell you what to do. You need to go to the BDA headquarters and give letter asking for the details regarding status of your survey number/s. Based on the reply taking help of an advocate, you can check the Court records for cases filed on the matter. Then depending upon the status and stage of case you can proceed with your cousin.

BDA acquiring land for the purpose of formation of sites. BDA wont promise. BDA officials might have assured you. Please consultation with an advocate with all your papers. Promise does not come in the law. offer and acceptance shall be by way of contract and in writing Good Luck.

You can visit the Bangalore Development Authority office and enquire about the status first. They should be able shed some light. Also approach a lawyer who will dig through the court papers to see if there are any pending cases
