Rera Complaint towards non registration of Flat in Noida

The Flat I am staying in Noida is unregistered even though a possession letter has been handed over to me.The builder still has Rs 200 crores pending dues to be paid to Authority.Its doubtful that in near futire he will be able to do so.Therefore I wish to File a Rera complaint for compensation of the lost opportunity for last four years,and surrender of Flat in which I am staying with refund of Purchase Price with interest.

I will need to know which builder it is. Also to cross verify the shared documents.

Accordingly I can guide.

Either compensation or as a last resort, refund to be demanded with interest as per RERA rules

For refund, you need to prefer a complaint under section 31 of the Real Estate and to seek compensation, you’ll have to approach the Adjudicating officer and not the RERA authority. You may also prefer a complaint before the consumer court. COnsult a local lawyer before acting l.

The builder can not force you to take possession without having completion certificate and registration of sale deed. you can file a petition before the RERA Court . you have options to go for filling the case in Rera court or in consumer forum. it is better to send a legal notice first then go for litigation. you can contact me for further information and guidance. you can contact me through the administrator of this website
