Booking amount can be forfeited if the same is mentioned in the agreement signed between you and the builder. RERA cannot override the effect of your liabilities mentioned as per law in the agreement which is enforceable in law. However agreement needs to be perused for any better advice. RERA empowers the homebuyer to cancel an allotment of the apartment booked with a builder at any stage even if there is no default on the part of the developer. It binds the builder to return the money collected from the buyers within 45 days of such cancellation after deducting the booking amount. and if you want to consult with me you can contact me.

Yes, in such scenario we can prefer to send the, a legal notice seeking refund of the amount paid and in case the builder fails to respond then we can file a complaint before RERA seeking refund of the amount along with interest
