Property related dispute between mother and son

if a son file a false case against mother then can she take back a property from him ? which she gave him 17 years back via aggrement to sell.

Mere agreement to sell can not be treated as valid title document if the same is not registered or executed or enforced as per law. If the sale deed or conveyance deed is in the favor of mother then she would treated as owner. For any further legal assistance please feel free to contact

Going back on an agreement to sell would amount to breach of contract and therefore may not be done. However, your mother may say that she was under undue influence and due to that she had entered into such agreement, meaning thereby that it can happen either ways.

If sale deed has not been executed within time limit of the terms mentioned in agreement to sell, then tilted hasn’t been changed and property is still under mothers name ..she can issue legal notice followed by suit for possession….plz b in touch asap

Your question is very in complete you have not mention whether a sale deed was executed or only agreement to sale was there if a registered sale deed was executed between you and your mother that in that case you are the absolute owner of the property and she can't claim for more details you can contact our office thank you

Contract is void if made under duress. But it will be difficult to justify the delay in filing a case. It’s been 17 years, limitation Act will come in.


It will be extremely tricky at this point. Since a consideration was reached between the parties there contract is valid.
